Raul Romaguera defended a skilled nursing facility in which an elderly dementia resident, who exhibited both aggression and combative behavior, suffered a fall while not using her walker. Four days later, it was revealed she sustained a pelvic fracture, even though the resident could move her limb and did not complain of pain. During her course of medical care, she experienced respiratory symptoms and was diagnosed with bilateral pulmonary embolism. After transfer to
hospice, she was suspected of having COVID-19. No acute pulmonary process was noted on x-ray. The resident died 22 days later. The legal battle ensued over the designation of COVID-19 on the death certificate and the real cause of death. As trial approached, the case settled for nuisance value after substantial demands were made.
